02Acceptance and scope

By accessing or using emerge-sa.com, including its English and Arabic versions and the contact form (together, the “Site”), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.

These terms apply to the Site only. Use of the emerge platform by subscribing customers is governed by a separate subscription agreement and, where applicable, a data processing agreement. If those documents conflict with these terms, they prevail for the platform.

If you use the Site on behalf of an organisation, you confirm that you are authorised to do so.

03Using the Site

You may use the Site for lawful purposes connected with evaluating our platform and services. You must not:

• copy, scrape, crawl or harvest content or data from the Site, other than through normal browser use or search engines that follow our robots directives;
• attempt to gain unauthorised access to the Site or any connected system, or probe or test their vulnerability without our written permission;
• introduce malware or interfere with the operation of the Site;
• submit false information, impersonate any person or organisation, or send unsolicited communications through our forms;
• use the Site in a way that breaches applicable law, including the Anti-Cyber Crime Law of the Kingdom of Saudi Arabia.

We may suspend or block access to the Site for anyone who breaches these terms.

04Information on the Site

• The Site provides general information about emerge AI systems and the emerge platform. We try to keep it accurate and current but do not guarantee that it is complete or error-free, and we may change it at any time without notice.
• Nothing on the Site is legal, tax, accounting, regulatory or investment advice. Descriptions of regulatory features, such as ZATCA e-invoicing or Wage Protection System payroll, describe capabilities of the platform and are not a representation that any organisation is or will be compliant. You remain responsible for your own compliance.
• Screens, dashboards, numbers, company and customer names, conversations and results shown on the Site, in the showreel and in demonstration videos are illustrative and do not depict real customers unless expressly stated.
• Features, modules and availability may change over time. Nothing on the Site is an offer capable of acceptance. Any pricing shown is indicative, excludes VAT unless stated, and is subject to a written quotation.
• A binding contract with us arises only through an agreement signed by both parties.

05Demo requests and communications

Submitting the contact form is a request, not a confirmed appointment. We may accept, reschedule or decline requests at our discretion. We will contact you using the details you provide, and you confirm that they are accurate and that you are entitled to share them. Our handling of your personal data is described in the Privacy Policy.

06Intellectual property

• The Site and everything on it, including text, design, graphics, illustrations, videos, animations, code and the selection and arrangement of content, are owned by us or our licensors and protected by the copyright, trademark and other intellectual-property laws of the Kingdom of Saudi Arabia and by international treaties.
• “emerge AI systems”, the emerge logo and the tagline “Emerge to Dominate.” are our trademarks or trade names. You may not use them without our prior written consent.
• We grant you a limited, revocable, non-exclusive licence to view the Site and to print or download extracts for your organisation's internal evaluation of our platform. Any other reproduction, distribution, modification or public display requires our written permission.
• Names and marks of third parties mentioned on the Site, including WhatsApp, ZATCA, GOSI and others, belong to their respective owners. Their mention does not imply affiliation, sponsorship or endorsement.
• If you send us feedback or suggestions about the Site or our platform, we may use them without any obligation to you.

07Third-party services and links

The Site links to services operated by others, including WhatsApp, Instagram, TikTok and Google Maps, and embeds a Google map on the contact page. We do not control those services and are not responsible for their content, availability or practices. Your use of them is subject to their own terms.

08Privacy

Our Privacy Policy explains what personal data we collect through the Site, how we use it, and your rights under the Saudi Personal Data Protection Law. It forms part of these terms.

09Disclaimer of warranties

To the fullest extent permitted by the laws of the Kingdom of Saudi Arabia, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, data or goodwill, arising from your use of or inability to use the Site or from reliance on its content. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud, gross negligence or wilful misconduct.

11Your responsibility

You agree to compensate us for losses, claims and costs, including reasonable legal fees, arising from your breach of these terms or your misuse of the Site.

12Changes

We may update the Site and these terms from time to time. The version number and date at the top identify the current edition. Changes take effect when published on the Site, and your continued use after that constitutes acceptance. We may also suspend or discontinue the Site or any part of it without liability.

13Governing law and disputes

These terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. If a dispute arises, the parties will first try to resolve it amicably within 30 days of written notice. Failing that, the competent courts of the Kingdom of Saudi Arabia have exclusive jurisdiction, without prejudice to any mandatory protections you may have under applicable law.

• If any provision of these terms is found invalid or unenforceable, the rest remain in effect.
• Our failure to enforce a provision is not a waiver of it.
• You may not transfer your rights under these terms. We may transfer ours to a successor of our business.
• These terms and the Privacy Policy are the entire agreement between you and us regarding use of the Site.
• These terms are published in Arabic and English. If the two versions differ, the Arabic version prevails.
